Terms of Business

These are the standard terms of business of Skyguard Flat Roofing LTD (“we”, “us”, “our”). They apply to all enquiries, surveys, quotations and roofing services we provide unless we’ve agreed something different with you in writing. ## 1. Who we are Skyguard Flat Roofing LTD is a limited company registered in England. Our registered office is Newsam Rd, Kilnhurst, Swinton, Mexborough S64 5UL, UK. Quotations & estimates - **Estimator tool** — the online estimator gives an **indicative price range** based on the information you provide. It is not a quote and is not binding on either party. - **Site surveys** are provided free of charge with no obligation to proceed. - **Written quotations** are valid for **30 days** from the date we issue them, unless we state otherwise. - All prices are quoted **exclusive of VAT** unless we expressly state “inc VAT”. VAT will be added at the prevailing rate where applicable. - Quotations cover the scope of work explicitly described in the document. Anything outside that scope — for example unforeseen issues discovered when stripping out (rotten deck, asbestos in old felt) — will be quoted as a variation and require your agreement before we do the work. ## 3. Acceptance & contract formation A contract is formed when you accept our written quotation (in writing, by email confirmation, or by paying a deposit). At that point you agree to these terms. We will agree a start date with you in writing before commencing work. ## 4. Carrying out the work We will: - Carry out the work with reasonable care and skill to current Building Regulations and manufacturer specification. - Provide a CSCS-carded site team where required, with appropriate PPE. - Keep the working area as tidy as practical and remove our waste from site on completion. - Issue Risk Assessments and Method Statements (RAMS) for commercial projects and on request. - Register your manufacturer warranty after sign-off (where applicable). You will: - Provide reasonable access to the property and any required services (water, mains power) during working hours. - Tell us about any known issues (asbestos surveys, restricted hours, listed-building or planning constraints) before work starts. - Move or protect anything in the loft, garage or under the roof that you don’t want exposed to construction dust. - Pay invoices in line with the agreed terms. ## 5. Variations & unforeseen works If, during the works, we discover something that materially affects the scope, cost or timescale — for example a rotten deck, asbestos, undeclared rooflights, or structural issues — we will: 1. Stop the affected work and make the area safe. 2. Tell you in writing as soon as practical. 3. Quote the additional work as a variation. 4. Only proceed once you’ve agreed the variation in writing. We will never carry out chargeable additional work without your consent. ## 6. Payment - **Domestic work**: payment in full on satisfactory completion, by bank transfer or card payment. - **Commercial work**: payment terms agreed at quote stage, typically **30 days from invoice**. - **Larger projects** (over £5,000 typically) may require a stage payment schedule, which will be set out in the quote. - Late payment may incur interest at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998. ## 7. Warranties - **Membrane / system warranty** — manufacturer-backed, typically **20 years** on a standard single ply replacement. The exact warranty terms depend on the system and are set out in the manufacturer’s warranty document, issued to you on completion. - **Workmanship guarantee** — **10 years** on our installation, covering defects in the way the work was carried out (as distinct from the materials themselves). - **Repairs** — **12-month workmanship guarantee** on the specific repair carried out. Does not cover other parts of the same roof failing later. - Warranties exclude damage caused by third parties, storm damage exceeding manufacturer-defined thresholds, foot traffic by unauthorised parties, modifications by others after our sign-off, and ordinary wear and tear. - Manufacturer warranties typically require **periodic maintenance** — see our [maintenance plans](/roof-maintenance) for detail. ## 8. Cancellation - **By you** — you may cancel before we begin work without charge. Once work has begun, you remain liable for work completed up to the point of cancellation, plus any non-refundable materials already ordered to your specification. - **Consumer Contracts Regulations** — if you are a consumer and the contract was concluded off our premises, you have **14 days** from the date of acceptance to cancel without reason. To exercise this right, contact us in writing within the 14-day period. - **By us** — we may cancel before work begins if we discover the work is not safely deliverable on the agreed terms, or if access cannot be provided. We will refund any deposit paid. ## 9. Limitation of liability - Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law. - Subject to the above, our total liability for any one project is limited to the contract value of that project. - We are not liable for indirect, consequential or business losses (loss of profit, business interruption etc). - We are not liable for issues arising from defects in the existing structure that were not visible or reasonably foreseeable at survey stage. - We strongly recommend you maintain appropriate buildings insurance throughout the works. ## 10. Photography & marketing We may take photographs of completed roofs for use in our portfolio, case studies, social media and website. **No identifying property or owner information is shared without your consent.** If you’d prefer we don’t photograph your roof, just tell us at quote stage. ## 11. Complaints If anything’s not right, please tell us first — most issues are sorted with a phone call to the team. Email info@skyguardflatroofing.co.uk with “Complaint” in the subject line. We aim to acknowledge within 2 working days and resolve within 14 days. For domestic clients, we are a member of the standard UK consumer protection framework. Unresolved disputes may be referred to your local Trading Standards via [Citizens Advice](https://www.citizensadvice.org.uk). ## 12. Governing law These terms are governed by the laws of **England and Wales**. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. ## 13. Changes to these terms We may update these terms from time to time. The version that applies to your contract is the one in force at the date of contract formation. The current version is always available at /terms.
